Details

The UH Fair Work Agency enforces fair-work and employment standards only within the functions and powers lawfully assigned to it.

Enforcement principles

Enforcement action must be lawful, evidence-based, proportionate, recorded and directed to the employment right or standard within the Agency’s remit.

The Agency may inspect and investigate compliance, require corrective action and use enforcement powers where legislation authorises them. A technical capability, job title or platform permission does not create an enforcement power.

Working with other bodies

The Agency works with Acas, the Central Arbitration Committee, the Certification Officer, HSE, courts, tribunals, police and other authorities where their separate functions are engaged. It does not absorb or override those functions.

Decisions and records

Enforcement decisions must identify the authority relied upon, relevant evidence, decision-maker and any applicable review or appeal route. Public information is published only where lawful and appropriate.
