This framework records the relationship between the Department for Work and Skills and the UH Fair Work Agency.
Status and purpose
The UH Fair Work Agency is an executive agency of the Department for Work and Skills. The Agency delivers labour-market compliance and enforcement functions assigned under Part 5 of the Employment Rights Act 2026 and other applicable United Hampshire legislation.
Governance
The Agency is led by a Chief Executive and supported by an Advisory Board. The Board provides strategic advice, scrutiny and challenge and does not exercise operational enforcement powers.
Responsibilities and boundaries
The Agency inspects and investigates compliance, requires corrective action and takes enforcement action only where lawful powers allow.
It does not replace Acas, the Employment Tribunal, the Central Arbitration Committee, the Certification Officer, the Equality and Human Rights Commission, the Health and Safety Executive or the Workforce Standards Inspectorate.
Sponsorship and accountability
The Department for Work and Skills is the sponsor department and the Minister for Employment is the responsible Minister. Agency authority comes from law and authorised delegations, not from platform permissions or technical access.
Records and reporting
The Agency maintains controlled enforcement, governance and reporting records. Public reporting must be derived from authoritative records and must not disclose protected case material.
